It said the agency considered THC-O to be a Schedule I controlled substance, leaving many to remove the products from their inventory. Now, the U.S. Court of Appeals for the Fourth Circuit has ruled this interpretation of the law is incorrect, saying the substance does fall under the legal definition of hemp.Products like these soared in popularity after the passing of the 2018 Farm Bill, which legalized hemp on the federal level. The law defined hemp as cannabis with 0.3% delta-9 THC or less. Anything with more than 0.3% delta-9 THC is considered illegal marijuana, a Schedule I controlled substance.“Because the statute is subject to this other reasonable (and, we think, better,) interpretation, we reject Diamondback’s contention that the DEA’s interim final rule or letter mandates a finding that THC-O is illegal,” the court’s opinion said. However, the court said its opinion would be little help to Anderson because she couldn’t vouch for the delta-9 THC concentrations in the products, so there isn’t a way to know definitively if they were legal under state and federal law.“This is because THCa meets the definition of ‘hemp’ when its delta-9 THC concentration does not exceed 0.3% by dry weight since the plain language of the Farm Bill, and rulings by both the Fourth Circuit and the Ninth Circuit courts of appeal, confirm that delta-9 THC is the sole metric to distinguish legal hemp from illegal marijuana and also because the definition of ‘hemp’ includes its ‘acids,’” Kight wrote.

We have a bit more clarity since the Fourth Circuit recently issued a decision that, in part, addressed the legality of hemp-derived products containing THC-O under the 2018 Farm Act.Our friends at Law360 have a nice summary of the facts, if you are interested. A threshold question is how to determine whether a certain hemp-derived product is legal under the 2018 Farm Act. The relevant provision defines legal “hemp” as “the plant Cannabis sativa L.The Fourth Circuit cited the Ninth stating, “[I]t didn’t need to consider the DEA’s position on synthetically derived substances because the definition of ‘hemp’ under the 2018 Farm Act was unambiguous in its application to all products derived from the cannabis plant, ‘so long as they do not cross the 0.3 percent delta-9 THC threshold.’” Likewise, the Fourth Circuit cited the Supreme Court’s decision to overturn Chevron, stating, “[W]e needn’t defer to the [DEA’s] interpretation.” · Under the Fourth and Ninth circuits’ understandings, hemp-derived products sourced from the plant are legal if the delta-9 THC levels do not exceed 0.3%. The Fourth Circuit went a bit further than the Ninth in its reasoning to hold that THC-O was legal, but the Fourth used the Ninth’s reasoning for support.In interpreting the DEA’s regulations, the Ninth Circuit stated, “[T]he source of the product—not the method of manufacture—is the dispositive factor for ascertaining whether a product is synthetic.” The Fourth Circuit noted that the “critical distinction that separates illegal marijuana and THC from legal hemp under both state and federal law is a product’s delta-9 THC concentration.”
